BidJam.co.uk - Terms Of Service

Definitions

Bidder: a person who has registered and submits a bid for a specific product/service offered on BidJam.

Bid: the amount of money that the bidder submits for a product/service in the BidJam auction.

Bidding Fee: a non-refundable fee that is charged for each bid.

Lowest Unique Bid: a bid that is the lowest single bid amount for a specific BidJam auction.

Credits: substitute used instead of cash to place bids.

Reserve Bid Amount: the minimum number of bids required to close the auction without regard to the published end date.

End Date: the date at which the BidJam auction will close, unless an extension is needed to acquire the reserve bid amount.

Successful Bidder: a person who BidJam acknowledges has the right to purchase a particular product/service on a BidJam auction.

Agreement

By registering with BidJam you are agreeing to the terms and conditions as set out below.

BidJam reserves the right to amend these terms and conditions at its own discretion.

Any changes to the terms and conditions will be published on the website.

Bidders’ Credentials

1.1 Must be aged 18 years or older.

1.2 You are legally permitted to participate in an online auction from the jurisdiction you are in at the time the bid was placed.

Registration

2.1 BidJam reserves the right to refuse to accept a registration and is not obliged to explain the reasons for doing so.

2.2 Bidder will not deliberately provide false information when registering.

2.3 Bidder will keep registration and personal details up to date.

2.4 Bidder agrees to keep both username and password confidential and is responsible for any misuse of them.

2.5 Bidder agrees to notify BidJam immediately after any fraudulent use of the account is suspected. Once notified BidJam will suspend your account immediately.

Privacy Policy

3.1 BidJam’s privacy policy can be seen in full on the website.

3.2 All personal details provided to BidJam will be treated as confidential in accordance with BidJam’s Privacy Policy and the Data Protection Act.

3.3 Once a BidJam auction has closed, BidJam will be entitled to use the winning bidder’s name, location, product and winning bid for publicity purposes.

Your Account

4.1 BidJam reserves the right to close or suspend an account and refund any monies held, without the need to give a reason.

4.2 Any amount mistakenly credited to a bidders account remains the property of BidJam. Such funds will be withdrawn from the bidders account and they will be notified of the transaction.

Placing Bids

5.1 BidJam reserves the right to cancel any bid without making a refund of the appropriate bidding fee where:

  • False information is provided by the bidder when using BidJam.


  • Where fraudulent activity is suspected.


  • Collaboration between one or more other players is suspected.


  • For any other reason.

5.2 You agree that the bidding fee is non-refundable.

5.3 Once a bid is placed it cannot be cancelled or changed, under any circumstances.

5.4 When a reserved auction closes without reaching the reserve number of bids the auction will be closed and all unsuccessful bids are automatically cancelled. All credits are automatically refunded back to your account for use on other auctions.

5.5 Any amounts lost by bidders while using BidJam are not recoverable, under any circumstances.

Delivery of Products/Services

6.1 The product/service will be delivered to the successful bidder once payment in full of the lowest unique bid has been made.

6.2 Products/services may be delivered to the successful bidders directly from the suppliers.

6.3 BidJam is not responsible for the quality of the products/services.

6.4 Should difficulties arise in the supply of the product/service, BidJam reserves the right to substitute for items of a similar quality/price.

Determination of the Successful Bidder

7.1 The successful bidder is the one who places the lowest unique bid on any particular auction.

7.2 In the event of there being no successful lowest unique bid, then the successful bidder will be the person with the lowest number with the least amount of bids that was placed first. If every bid is duplicated exactly, then the lowest unique bid would be the lowest number that was placed first.

7.3 The successful bidder has 30 days from the closing date of the auction to pay for the product/service, after which their right to purchase the product/service will be void.

Publicity

8.1 The successful bidder may be required to take part in promotional activities, where the winners name, image, and likeness is used.
